ENTRY VIA ONLINE PURCHASE (Entrant's online consent to participate in the Promotion is required to enter via an online purchase.): Internet access required*. Throughout the Promotion Period, eligible entrants will earn one (1) entry for every $1 spent on qualifying purchases of Ridetousness merchandise/product items made online at www.Ridetousness.com (the "Website"). The number of entries received will be based on the list price of the eligible purchase (excluding discounts, sales tax, and shipping charges) and will be rounded up to the next $1 increment. If a purchase is returned before the drawing, associated entries will be voided. All purchases are subject to Sponsor's return policy. Purchase transactions must be completed by 11:59:59 PM CST on November 01, 2024, and must include consent to be entered in the Promotion to be eligible for entry via purchase. There is no limit per month on the number of entries received with a purchase and entrant's consent. Throughout the Promotion Period, entrants will also have the option to opt-in to receive further email communications from the Sponsor. Opting-in is not required to participate in the Promotion, and it will not increase your chances of winning. If an Entrant chooses to opt-in, they thereby grant the Sponsor permission to send future communications regarding services, incentives, offers, promotions, or other messaging related to the Sponsor's services and products, which entrant can unsubscribe from at any time.

ENTRY VIA NO PURCHASE NECESSARY METHOD OF ENTRY: obtain fifty (50) entries without purchasing anything, follow these steps: On a 3”x5” plain paper, handwrite your full name, address, city, state, zip code, date of birth (mm/dd/yyyy), email address, and daytime telephone number with area code. Mail your entry in a #10 business-size envelope with first-class postage to: Motorycycle Giveaway #01, 224 W Campbell Rd Unit 245 Richardson, TX 75080. Ensure your outer envelope includes a valid return address with your full name. Entries without a legible return address will be considered incomplete and invalid. Only one entry per outer envelope is permitted; bulk shipments are not accepted. All entries, including the outer envelope, must be handwritten; no mechanically reproduced or metered entries are allowed. Entries must be postmarked by the promotion end date, November 1, 2024, and received by November 13, 2024, to be eligible for the drawing. If the postmark date is on a Sunday or federal holiday, the entry must be postmarked on the next business day. Each mail-in entry will count as twenty (50) entries if it complies with the specified requirements.

Mail-in entries that do not adhere to the provided format, are illegible, inaccurate, incomplete, or reproduced via photocopier or other means will be considered void. We are not responsible for lost, late, illegible, mutilated, misdirected, or postage-due entries, or entries not received by the deadline. All submitted materials become the property of the Sponsor and will not be returned. We will not acknowledge or respond to correspondence regarding mail-in entries, including requests for confirmation of receipt.

ENTRY MULTIPLIER OFFERS: During the Promotion Period, the Sponsor may (but is not obligated to) provide opportunities to increase the number of online purchase entries through a multiplier, such as (2X), (5X), (10X), (20X), (30X), and (40X) (each an "Entry Multiplier"). When an Entry Multiplier is available, entries will be multiplied by the applicable Entry Multiplier. For instance, a $30 purchase during a 10X Entry Multiplier offer will earn 500 entries (30x10=300). Timing for an Entry Multiplier offer will be determined solely by the Sponsor and will be announced on their Website (www.Ridetousness.com) and/or its social media pages.To obtain additional entries during an Entry Multiplier offer without making a purchase, please adhere to the instructions outlined for mail-in entries in section  below. Handwrite the phrase "ENTRY MULTIPLIER" along with the specific Entry Multiplier (e.g., 2X Entry Multiplier) on the bottom right-hand corner of your mail-in envelope. Ensure that your mail-in entry is postmarked corresponding to the date an Entry Multiplier is offered and received within 5 days of the offer's deadline. If an Entry Multiplier offer concludes on a Sunday or federal holiday, the Multiplier mail-in entry should be postmarked on the subsequent business day and received within 5 days of the offer deadline. Each mail-in entry meeting the aforementioned criteria will earn the appropriate number of entries based on the respective multiplier offered. For instance, a valid Mail-In Entry received during a 2X Entry Multiplier offer (as delineated in this paragraph) will garner 120 entries per mailing envelope, and so forth. *Standard internet access, phone, and usage charges may apply as per your online or phone service provider. If entering via a mobile device and utilizing your wireless carrier's network, standard data charges from your wireless carrier may also apply.

RANDOM DRAWING & WINNER NOTIFICATION: The selection of each winner will be determined through a random drawing conducted by the Administrator on or about  November 15, 2024. The announcement of the winner(s) will take place on or about November 15, 2024, on the Ridetousness Discord server. Winners will be contacted using the email addresses or other provided contact information submitted during entry or registration for the Sweepstakes. Upon notification, winners must complete, sign, and return an Affidavit of Eligibility, a Liability Release, and, if applicable by law, a Publicity Release within five (5) calendar days. Failure to comply with these requirements, or if a winner is deemed ineligible by the Administrator, will result in forfeiture of the prize. In such cases, an alternate winner will be selected through a random drawing from eligible entries and notified accordingly. Three additional alternate drawings will be conducted if necessary, after which the prize will remain unawarded. All decisions made by the Administrator are final. The odds of winning each prize depend on the total number of eligible entries received. This Sweepstakes is void where prohibited or restricted by law.

PRIZES: One prize will be given away, comprising a grand prize of a 2020 Yamaha R1M motorcycle valued at around $25,000. The grand prize winner will be the sole recipient of this prize. In this document, the grand prize will be collectively referred to as the "Prize(s)," and the recipient(s) as the "Winner(s)." Sponsor will arrange for the delivery of the Prize(s) to the winners' specified physical locations within the 48 contiguous United States and the District of Columbia, subject to Sponsor's approval. Prize delivery is expected to occur within 15-30 days after the Winner(s) have submitted a signed Affidavit of Eligibility and Publicity Release (where permitted).

Prizes are subject to availability and may be altered or adjusted at the discretion of the Sponsor. Upon request, Winners must provide Sponsor with valid identification, a valid driver’s license, and/or a valid taxpayer identification number or social security number as prerequisites for receiving the Prizes. The Prizes cannot be transferred, exchanged for cash, or substituted with any other prize. Any income taxes associated with the Prizes are the sole responsibility of the Winners. The estimated retail value of the Prize is approximately $28,000. SPONSOR CANNOT AND DOES NOT GUARANTEE THAT THE GRAND PRIZE  CAN BE REGISTERED AS STREET LEGAL IN ANY GIVEN STATE.

TAXES: The stated prize value is determined using information reasonably available to the Sponsor. The total value of prizes awarded to winners will be reported for tax purposes as mandated by law. Winners are responsible for reporting and paying any applicable taxes. Winners receiving prizes totaling over $600 will receive an IRS Form 1099-MISC at the year's end, with a copy filed with the IRS.

PRIVACY & TERMS: Any information provided by the Entrant will be governed by the Sponsor’s Privacy Policy, accessible online at this link (“Policy”), as well as the Terms & Conditions available here. By submitting information for this Sweepstakes, whether required or not, such as mailing address, phone number, social media usernames, and email address, the Entrant grants permission for the Sponsor to include them in the Sponsor’s customer database and to contact them in the future for promotional and other purposes. Entrants have the option to opt-out of receiving such communications, as outlined in the Sponsor’s Privacy Policy found here or as indicated within any marketing materials received (e.g., using the “Unsubscribe” feature in email footers). By participating in the Sweepstakes, the Entrant acknowledges having read and agreed to the Policy, and consents to the collection, use, and disclosure of their personal information in accordance with the Policy. Additionally, by entering the Sweepstakes, the Entrant agrees that if selected as the Winner, they are bound by the Sponsor’s Terms and Conditions.

DISCLAIMER: All prizes are awarded "as is" and without any warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), and all such warranties are hereby disclaimed.

LIMITATIONS OF LIABILITY, RELEASE & FORCE MAJEURE: Sponsor, Sponsor’s affiliates, Administrator, Administrator’s affiliates, and platforms such as Google, YouTube, Facebook, Instagram, and Twitter shall not be held responsible for: (i) technical problems or malfunctions affecting the operation of the Sweepstakes, including but not limited to: (a) hardware or software errors; (b) faulty computer, telephone, cable, satellite, network, electronic, wireless, or internet connectivity, or other online communication issues; (c) errors or limitations of any internet service providers, servers, hosts, or providers; (d) garbled, jumbled, or faulty data transmissions; failure of email transmissions to be sent or received; (ii) lost, late, delayed, or intercepted transmissions; (iii) inaccessibility of any website, in whole or in part, for any reason, or internet traffic congestions; (iv) unauthorized human or non-human intervention in the operation of the Sweepstakes, including unauthorized tampering, hacking, theft, viruses, bugs, or worms; (v) destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility, or unavailability of an account used in connection with the Sweepstakes; (vi) any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Site; (vii) any personal injury, property damage, or losses sustained by an Entrant or any other person's computer equipment arising from participation in the Sweepstakes, use of any website, or the download of any information from any website; (viii) any attempt by an Entrant or other individual to deliberately damage or undermine the legitimate operation of the Sweepstakes, including but not limited to any fraudulent claims, which may violate criminal and civil laws; and/or (ix) lost, stolen, or destroyed passports, airline tickets, hotel reservation documents, or any other items or materials required to claim, use, or benefit from the Prize. ANY PERSON ATTEMPTING TO DEFRAUD SPONSOR OR ADMINISTRATOR OR IN ANY WAY TAMPER WITH, DAMAGE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES WILL BE DISQUALIFIED AND MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PROSECUTION.

Sponsor, Sponsor’s affiliates, Administrator, Administrator’s affiliates, and platforms such as Google, YouTube, Facebook, Instagram, and Twitter, along with their respective subsidiaries, affiliates, successors, assigns, and all past and present officers, directors, owners, shareholders, members, managers, partners, principals, employees, attorneys, insurers, agents, and representatives (collectively referred to as "Released Parties"), shall not be held liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to: (i) by any wrongful, negligent, or unauthorized act or omission of the Entrant or any third party; or (ii) by any cause, condition, or event beyond the control of the Released Parties, including, without limitation, any act of God, war, terrorism, riot, hurricane, or fire.

BY ENTERING THE SWEEPSTAKES, ENTRANT IRREVOCABLY, FULLY, AND UNCONDITIONALLY RELEASES, DISCHARGES, AND HOLDS HARMLESS EACH RELEASED PARTY FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, LOSSES, EXPENSES, ATTORNEY’S FEES, DAMAGES, AND OTHER LIABILITIES ARISING OUT OF OR RELATING TO ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES AND SWEEPSTAKES-RELATED ACTIVITIES (SUCH AS ACCEPTANCE, POSSESSION, USE, MISUSE, OR NON-USE OF ANY PRIZE), INCLUDING, WITHOUT LIMITATION, AND TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, DEMANDS, CLAIMS, AND CAUSES OF ACTION FOR NEGLIGENCE, DAMAGES TO PROPERTY, BODILY INJURY (INCLUDING DEATH), PROPERTY DAMAGE, LOSS OF BUSINESS, LOSS OF CONSORTIUM, CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES, AND ALL OTHER FORMS OF CLAIMS, LIABILITIES, AND DAMAGES.

NOTICE TO CALIFORNIA RESIDENTS: By participating in the Sweepstakes, you acknowledge your familiarity with the provisions of California Civil Code Section 1452, which states:
"A general release does not extend to claims which the creditor does not know or suspect to exist in their favor at the time of executing the release, which if known by them must have materially affected their settlement with the debtor."

By entering the Sweepstakes, the Entrant (on their own behalf and on behalf of their heirs, executors, administrators, personal representatives, and all other individuals asserting rights or acting on behalf of the Entrant) hereby unconditionally waives and relinquishes any right or benefit that they or such individuals may have against the Released Parties, under Section 1542 of the Civil Code of the State of California, or under any similar statutory or common law of any other jurisdiction, to the full extent that any such person may lawfully waive such rights and benefits pertaining to the releases set forth in these Official Rules and Sponsor’s Terms and Conditions and Privacy Policy available here.

ARBITRATION; DISPUTE RESOLUTION: All disputes arising under or related to these Rules shall be governed by and interpreted pursuant to the laws of the State of Texas and the United States of America without regard for conflicts of laws principles. All disputes arising under or relating to these Rules shall be submitted to and resolved by binding arbitration in Travis County, Texas, and any award shall be confirmed exclusively in the courts situated in Travis County, Texas. The Entrant further irrevocably agrees and consents

NOTICE - WEBSITE DAMAGE: Any deliberate attempt by an individual to harm a website or disrupt the legitimate operation of this promotion violates criminal and civil laws. In such cases, the sponsor reserves the right to seek damages to the fullest extent permitted by law. The Promotion Entities are not accountable for faulty, incorrect, undeliverable, or mistranscribed phone/email/internet transmissions, incorrect announcements, technical hardware or software failures, including any injury or damage to a person's computer related to participating in the promotion. Additionally, the Promotion Entities assume no responsibility for undeliverable emails due to active or passive email filtering or insufficient space in the recipient's email account.

The sponsor reserves the right to cancel or modify the promotion if events beyond their control, such as fire, flood, epidemic/pandemic, labor disputes, acts of God or public enemies, force majeure events, or instances of fraud, misconduct, or technical failures, compromise the integrity of the program. In case of termination, notice will be posted online, and a drawing for the Grand Prize will be conducted from eligible entries received prior to termination. Failure of the Released Parties to comply with these rules due to acts of God, epidemic/pandemic, or force majeure events will not be considered a breach of the rules.

In case of a dispute regarding the entrant's identity, the entry will be attributed to the person named on the online order form or mail-in entry. Any damage caused to the website by an entrant will be their responsibility or that of the authorized email account holder submitted at the time of entry. Proof of submission does not guarantee receipt by the Sponsor. Entries suspected of being fraudulent, including those using automated methods, will be disqualified at the Sponsor's discretion. The Sponsor reserves the right to prohibit participation or disqualify individuals suspected of fraud or tampering or failing to comply with participation requirements or these Official Rules.

WINNERS LIST AND RULES: The Prize Winner's name will be published on www.Ridetousness.com around November 15, 2024, or upon verification of the Grand Prize winner. The Official Rules will be available on www.Ridetousness.com for the duration of the Promotion Period.
